Terms of Service

1. Acceptance of terms

By accessing or using CreativesInTexas (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, registered users, and anyone else who accesses the Service.

2. Service description

CreativesInTexas is a statewide directory of Texas-based creative professionals. It allows creatives to create public profiles showcasing their work, and allows hirers to search and contact those creatives directly. The Service is provided by The Creative Agenda, LLC ("we," "us," "our"), a Texas limited liability company.

3. Accounts and responsibilities

To create a creative profile you must register for an account. You are responsible for:

• —Keeping your account credentials confidential.
• —All activity that occurs under your account.
• —Providing accurate, truthful profile information.
• —Promptly updating your profile if your information changes.

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable use

You agree not to use the Service to:

• —Post false, misleading, or fraudulent profile content.
• —Impersonate another person or entity.
• —Scrape, crawl, or harvest user data in bulk without written permission.
• —Spam, harass, or send unsolicited commercial messages to other users.
• —Circumvent any technical measures we use to protect the Service.
• —Use the Service for any unlawful purpose or in violation of applicable law.

5. Profile content and ownership

You retain ownership of the content you submit to your profile — your images, bio, reel links, and other materials. By publishing your profile, you grant The Creative Agenda, LLC a non-exclusive, royalty-free, worldwide license to display and distribute that content through the Service for the purpose of making your profile publicly searchable.

You are solely responsible for ensuring you have the rights to any content you upload. We may remove content that violates these terms or applicable law.

6. Subscriptions and billing

Paid subscription plans (Pro and Pro Plus) are billed on a monthly or annual basis through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the rate in effect at the time of purchase.

• —You may cancel your subscription at any time from the billing section of your dashboard.
• —Cancellation takes effect at the end of the current billing period — you retain access until then.
• —We do not offer refunds for partial periods, except where required by law.
• —We reserve the right to change subscription pricing with at least 30 days' notice.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not verify the accuracy of any creative's profile information, credentials, or the quality of their work. Any hiring decisions made through the Service are solely between you and the creative.

8. Limitation of liability

To the maximum extent permitted by law, The Creative Agenda, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability to you for any claims arising under these terms will not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We may suspend or terminate your account at any time for violation of these terms, or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from your dashboard settings.

10. Governing law

These Terms of Service are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these terms will be resolved exclusively in the state or federal courts located in Bexar County, Texas.
